TERMS OF SERVICE

Varcorb provides technology services including but not limited to:

• Custom web application development
• Static website design and development
• Network management and Ubiquiti hardware rental

The specific scope, deliverables, timeline, and pricing for any project will be outlined in a separate written proposal or agreement between Varcorb and the client.

All projects are governed by a written proposal or statement of work that will include:

• A detailed scope of work and deliverables
• Project timeline and milestones
• Pricing and payment schedule
• Revision and change request policies

Work will not commence until the proposal is accepted and any required deposit is received. Changes to the project scope may result in adjustments to the timeline and cost, which will be communicated and agreed upon in writing.

Payment terms are outlined in each project proposal. Our standard structure is as follows:

Network management services are billed monthly. Invoices are due within 15 days of receipt unless otherwise specified. Late payments may incur additional fees as outlined in the project agreement.

Upon full payment, the client receives ownership of all custom source code, designs, and assets created specifically for their project. This includes:

• Custom application source code
• Design files and visual assets created for the project
• Custom content written for the client's website or application

Varcorb retains the right to use general knowledge, techniques, and non-proprietary components (such as open-source libraries and frameworks) in future projects. Varcorb also retains the right to display the project in its portfolio unless the client requests otherwise in writing.

For network management clients, Ubiquiti hardware is provided as part of the monthly rental service. The equipment remains the property of Varcorb. Clients agree to:

• Use the equipment in a reasonable manner consistent with its intended purpose
• Not modify, disassemble, or tamper with the hardware
• Return all equipment in reasonable condition upon termination of service

Varcorb will replace defective or failed equipment at no additional cost during the service period. Damage caused by misuse, negligence, or unauthorized modifications may result in replacement charges.

Varcorb strives to deliver high-quality work that meets the specifications outlined in each project proposal. All projects include a post-launch support period for addressing bugs and minor issues.

Beyond the support period, our services are provided "as is" without additional warranties unless covered by a separate maintenance agreement. We are not liable for issues arising from third-party services, client-side modifications, or circumstances beyond our reasonable control.

To the maximum extent permitted by law, Varcorb shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from the use of our services or website.

Our total liability for any claim arising from a project shall not exceed the total amount paid by the client for that specific project.

Either party may terminate a project agreement with 30 days written notice. In the event of termination:

• The client is responsible for payment for all work completed up to the date of termination
• Varcorb will deliver all completed work and materials
• Deposits are non-refundable once work has commenced

For network management services, clients must provide 30 days notice to cancel. All equipment must be returned within 14 days of service termination.

By using this website, you agree not to:

• Use the site for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorized access to any part of the site or its systems
• Reproduce, duplicate, or exploit any portion of the site without written permission
• Transmit any harmful code, viruses, or malicious content

These Terms of Service are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any disputes arising under these terms shall be resolved in the courts of Montgomery County, Texas.

Varcorb reserves the right to modify these Terms of Service at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our website or services after any changes constitutes acceptance of the revised terms.
